The simple truth is that divorce, even when the parties desire to proceed on an uncontested basis, is unpleasant. A highly experienced family law attorney and trained mediator can assist you and your spouse through the difficult process of formally ending a relationship which may well go back many years with as little acrimony and expense as possible.
At the Law Offices of Paul M. Gaide we are uniquely qualified in being able to combine over 29 years of legal experience and training as a mediator, with years of experience in finance, tax, accounting, real estate, insurance and business planning so as to offer disputing parties in Colorado a comprehensive mediation experience.
Judges in the State of Colorado will uniformly tell parties before them in divorce cases that: (a) "no one wins"; and (b) the parties are in the best position to plan for their futures, and those of involved children, as opposed to leaving their futures to a Judge who will not know you and will have very little time to attempt to understand your situation before entering a life changing and potentially long-lasting order.
While we recognize that there are significant emotions surrounding a divorce, under Colorado law, the "fault" of either party which is the perceived cause of a divorce is not generally a factor which the Court will think relevant.
Our function in mediation will be to assist each of you in reducing the emotional tension ancillary to divorce, and to assist each of you in crafting solutions which are fair, equitable, and in the best interests of your children, should children be involved, and prepare all documentation necessary to effectuate your agreements, at fixed and transparent pricing. See our Flat Fee Rate page.
Generally speaking, the traditional divorce process in Colorado which involves the parties, attorneys, judges, and courtrooms exacerbates divorcing parties' natural inclinations to protect themselves at all costs, to be unreasonable (for a variety of reasons), and all too often results in outcomes which the parties regret, both in terms of decisions reached by the Court and the time, emotional and financial expenses of achieving the unsatisfactory result.
The traditional attorney in divorce cases in Colorado, depending upon experience, location and the perceived complexity of the matter, will ask for a retainer of between $2,500.00 and $10,000.00, against which they will typically invoice their client at the rate of between $200.00 to $500.00 per hour. While the traditional attorney should have your best interests at the forefront of his / her mind at all times and keep your costs and expenses as low as possible, under the circumstances of the case, the reality is that the traditional divorce "process," which is designed to shepherd contested divorce cases through the courts, is time consuming and fraught with inefficiencies, all of which increase the costs to the parties.
For parties who desire to obtain a divorce on a non-contested, consensual basis, with the least amount of time, emotional and financial expense possible, the Law Offices of Paul M. Gaide assists such parties by working with both parties to the divorce, in the context of mediation. We do not represent either party independently of the other. Our goal is to assist you in reaching and documenting agreements which you believe are fair and equitable and which we believe will likely be acceptable to the Court.
